The E2 Treaty Investor Visa holder currently has no pathway to Legal Permanent Status - Green Cards.
This is an issue that we hope can be addressed in Congress and a pathway could be allowed after maybe 10 years.
The E2 Treaty Investor Visa has been in place since the 'Immigration and Nationality Act of 1952'. Since that time the only change has been to allow E2 Spouses to gain employment outside of the E2 business.
This is a Non Immigrant Visa that asks for investment into the US Economy in the form of buying an existing, or setting up a new, business and the creation of jobs for US Citizens.
We believe it is the only visa that asks for a substantial investment that does not lead to Permanent Residency.
Many talk about a 'Line' for immigrants to get into - for E2 Treaty Investor Visa holders, at the moment there is no line.
The E2 Treaty Investor Visa is open to citizens of over 70 countries from around the world, bringing rich diversity to the US.
The E2 Treaty Investor Visa could deliver so much more and save future investors looking at other, more welcoming, countries.
The E2 Treaty Investor Visa does not cover dependents (our children) when they reach the age of 21. They must find other ways to stay - usually an International Student visa - F1 - if they are attending college, the purchase of an E2 business in their own right (not easy as they have no business experience as they are not entitled to Social Security Numbers whilst they are dependents) or marriage. This can cause families to be torn apart and is probably the main reason for E2 Treaty Investor Visa holders leaving the US.
Sadly these children have been continually overlooked, as there is a universal assumption that they have alternative ways to stay.
We have had good support from many Representatives in Washington and hope to continue this in the Future.
There are believed to be 100,000 E2 Treaty Investor businesses in the United States, although there is no Official Data available that tells us exactly how many.
Figures from the State Department tell us numbers of E2 Visas issued have been steadily increasing from 11,000 in 1987 to over 41,000 in 2018, with a Peak in 2016 of over 44,000.
However there is no breakdown to tell whether these are new businesses, renewals, or E2 Manager/Essential Worker visas.
These numbers come from the Department of State Non Immigrant Visa Statistics, using the Individual Class of Admission Tables.

Employees – 800,000 - 1million
Initial Investment - $27 Billion
Sales – over $100 Billion
Wages - $3.7 Billion
E2 Treaty Investor businesses would expand with a secure platform to work from. They are currently only able to plan so far ahead because of the restraints the renewal process puts onto them.
A large percentage of E2 Treaty Investor Visa holders own homes in the US – some more than one. They also invest in cars and trucks, for both their own use and for their business. The impact of our direct, indirect and diffused investment and employment is huge.
E2 Visa holders are not able to retire in the US as they must own and be directing a business to stay. Many E2 Treaty Investor Visa holders will become eligible for Social Security after 10 years - 40 Quarters - of payments. If they are not able to retire here, this could be taken, and used, outside of the US. A variety of positive factors indicate reasons why this situation would benefit from their continued presence.
E2 Treaty Investor Visa holder's main wish is to be treated fairly along with other groups of immigrants within the whole Immigration Reform Debate. This is a sensible part of immigration reform that is not contentious and could easily be independent specific, or incorporated within other plans.
